China's industry ministry has told provincial departments to survey and compile AI application service providers into a national pool, with a first report due 1 December 2026 and a target of more than 2,000 firms by the end of that year
A national pool of AI service firms, due at the ministry by December 2026, with numeric targets attached to every province. Nothing in it binds a company, and nothing in it is actionable this year.
Bottom line: MIIT has told provincial industry and information technology departments to survey AI application service providers, build regional resource pools and report them to the ministry by 1 December 2026. Who this affects: Executives sourcing AI services in China, who should know a government-assembled supplier list is being built and when it lands. The obligations fall on provincial administrations; the notice imposes none on any firm.

What changed: There is no new legal requirement for a company. What is new is a national pool being assembled to a deadline, with numeric targets attached to each province, and a stated intention to publish the national pool.
Analysis: A registry-building programme with no firm-facing duty and a first deliverable fifteen months out. For a Western reader its value is a date to diary and a method for reading the next Chinese instrument, not a compliance obligation. Reported as a new Chinese AI rule it would be simply wrong.

What the notice sets out to build
The General Office of MIIT released a notice on 31 August 2026, drafted four days earlier, launching what it calls a special action to cultivate artificial intelligence application service providers.
The category it is building around is defined in the text: enterprises or institutions that, around user organisations' intelligent transformation needs, provide AI solution consulting and planning, delivery and implementation, operations management, and security governance services.
The numeric targets are the substance. By the end of 2026 the national provider resource pool is to exceed 2,000 firms. By the end of 2027 it is to hold not fewer than 3,000. Provinces that host a national AI industry innovation and application pilot zone are to have not fewer than 100 firms in their own regional pool by the end of 2027.
There is a separate figure for what the notice calls AI application service teams: each region is in principle to report not fewer than ten, each led by one provider with not fewer than two upstream or downstream units taking part. The qualifier translated here as in principle is in the original, and it softens what would otherwise read as a quota.
The mechanics are dated. Regions consolidate provider files into a regional pool, follow the reporting requirements set out in an annex, and submit the pool to the ministry's Department of Science and Technology by 1 December 2026, updating it periodically. Summary reports on task completion are due by 1 December 2027. The ministry says it will consolidate the regional pools into a national one, publish it in due course, and build an online platform for it.
The notice miscites its own annex
There is a defect in the document itself.
Clause three, subsection three, directs regions to summarise task completion and submit the summary report by 1 December 2027, citing (附件4). Annex 4 is the AI application service team information form. The summary report template is annex 5.
The same clause group cites annex 4 correctly one subsection earlier, for the service team information that accompanies the pool submission, so the notice uses the same annex number for two different attachments.
This report reproduces the citation as printed. A silently corrected reference cannot be reconciled against the document itself, which is the point of quoting a document at all.
Who the notice binds
The addressee line sits immediately under the document number, before any substantive text, and names the competent departments for industry and information technology of all provinces, autonomous regions, municipalities directly under the central government, and the Xinjiang Production and Construction Corps. No company or class of firm is addressed.
The grammar holds throughout. Regions organise the survey and build provider files; the ministry consolidates, establishes a tracking and evaluation mechanism, and strengthens overall guidance. The quantitative targets are indexed to regions and provinces.
One clause will be read as a compliance duty. Among the tasks under improving service supply, the notice says providers are to be guided to embed management requirements including network security, data security, ethical governance and business compliance into the full process of research, deployment and application, turning passive response into active prevention and control. The verb is guide and its subject is the addressee department. It assigns the department a task; it does not impose a duty on a firm.
That pattern runs through the provider-facing tasks generally, where the governing verbs are supporting, encouraging, guiding and organising. There is no should, must or must not aimed at a firm anywhere in the operative text, and the notice states no penalty for non-participation. What it offers firms instead is inducement rather than obligation: computing power vouchers, opened interfaces to models and scenarios from earlier ministry programmes, joint training bases with universities, and preferential policy support for regions that perform well.
The harder conditions are real but they are admission criteria, and they live in the annexed reporting requirements rather than the notice body: Chinese registration, a clean three-year credit record, no intellectual property infringement, evidenced dedicated staff, a case-volume threshold, and the filings that already apply, including the CAC filing for generative AI with public opinion attributes or social mobilisation capacity. They are conditions of entry to a voluntary pool and largely restate regimes that already exist in Chinese law.
What to do about it
If you buy AI services in China, the pool is the artefact to track. A government-assembled, published list of vetted providers is a procurement input, and the dates that matter are 1 December 2026, when regional pools are due at the ministry, and the end of 2027 for the 3,000 firm target. Neither gives you anything to act on today.
The transferable part is the reading method. Find the addressee line of a Chinese 通知, a notice directed down to subordinate bodies, then check whether the operative sentences take an administration or a company as their subject. An instrument of this kind binds the hierarchy it is addressed to and reaches firms only through what that hierarchy then does. Run that test on the next one that crosses your desk.

Open the notice on the ministry's own site and confirm five things from the document header and body. The 发文字号 reading 工信厅科函〔2026〕414号, with 成文日期 2026-08-27 and 发布日期 2026-08-31. The addressee line 各省、自治区、直辖市及新疆生产建设兵团工业和信息化主管部门, which names only administrations. Under 一、行动目标, the two targets 突破2000家 by end-2026 and 不少于3000家 by end-2027. Under 三、工作安排, subsection one, the reporting deadline 于2026年12月1日前 to the Department of Science and Technology. And in 任务二, the clause beginning 引导服务商将网络安全、数据安全、伦理治理、业务合规.
