What HC 142 requires
A person responsible for a Court Document must independently verify GenAI-assisted material before use. The Direction says that using the same or another GenAI tool to confirm accuracy is not sufficient.
Fabricated, manipulated or deepfake evidential material must never be used or presented to the Court. Witness statements and affidavits using substantive GenAI content require the Direction's declaration unless the Court directs otherwise. Expert reports have parallel declaration and disclosure requirements.
Who needs a workflow before 1 September
Litigation teams should identify where GenAI appears in research, drafting, evidence preparation and expert work. The responsible person must independently verify GenAI-assisted material before use.
